Terms of Service – Azavex Apparel

Last updated: October 1, 2026

In these Terms, “Azavex Apparel,” “we,” “us,” and “our” refer to the Azavex Apparel brand and store.

These Terms govern your use of our website and purchases from our store. Please read them before placing an order. By submitting an order and accepting the Terms presented at checkout, you agree to the conditions applicable to that purchase.

Nothing in these Terms excludes or limits rights that cannot legally be excluded or limited.

1. Related Policies

Our Shipping Policy and Return & Refund Policy, as made available before purchase, also apply to your order.

Our Privacy Policy explains how we handle personal information. Accepting these Terms does not replace any separate consent required for marketing or optional tracking technologies.

Mandatory consumer protection law takes precedence over a conflicting provision.

2. Eligibility and Customer Responsibilities

You must be legally able to enter into a purchase contract under the laws that apply to you.

Provide accurate contact, payment, and delivery information, use only payment methods you are authorized to use, and contact us promptly if important order details need correcting.

Use our website and products lawfully. If you create an account, keep your login details secure and report suspected unauthorized access.

3. Product Information and Availability

We take reasonable care to describe products accurately, including their features, materials, sizing, dimensions, and compatibility.

Colors may appear differently depending on screen settings and lighting. This does not remove your rights if a product is faulty or materially different from its description.

Relevant availability, quantity, or delivery restrictions will be disclosed before purchase. Product changes or discontinuation for future sales do not automatically change an accepted order.

4. Orders and Acceptance

Submitting an order is a request to purchase the selected products.

An email that only acknowledges receipt does not, by itself, constitute acceptance. We accept your order when we send a confirmation expressly accepting it or dispatch the products, whichever occurs first.

Before acceptance, we may decline an order for a reasonable reason, including unavailability, unsuccessful or unauthorized payment, reasonable evidence of fraud, inability to deliver, a material pricing error, or a legal restriction.

We will notify you if an issue prevents fulfillment unless notification is prohibited by law.

After acceptance, we will only cancel or materially change an order where legally permitted or with your agreement. If we cancel a paid order, we will promptly refund the amount due for the canceled products and relevant delivery charges.

5. Prices and Payments

Prices are shown in the currency identified on the website or at checkout.

Taxes, shipping fees, and other charges collected by us will be shown before you submit your order. Any responsibility for import charges not collected at checkout will be disclosed before purchase where applicable.

Price changes apply to future purchases, not automatically to accepted orders.

If we identify a pricing error before acceptance, we will explain the correction and let you proceed at the corrected price or cancel. We will not charge an additional amount without your authorization.

Payments are handled by third-party providers. Your bank or payment provider may apply separate conversion rates or fees.

Promotions, discounts, and promotional codes are subject to the conditions disclosed with the relevant offer.

6. Order Changes and Cancellations

Email help@azavex.com as soon as possible if you need to change or cancel an order.

Voluntary changes depend on the order’s production, packing, or dispatch status.

For personalized or made-to-order products, please carefully check spelling, artwork, sizing, color, and selected options before ordering. Changes may become impractical once production has begun.

These operational limits do not remove statutory cancellation rights or remedies for faulty, incorrect, or misdescribed products.

7. Shipping and Delivery

Our Shipping Policy explains processing periods, transit estimates, charges, tracking, and assistance with delivery issues.

Processing time and transit time are separate unless expressly stated otherwise.

Carrier disruption or customs delays do not automatically remove our delivery obligations. If we cannot meet an applicable shipping commitment, we will notify you and obtain agreement to a revised timeframe or offer cancellation and a refund where required by law.

Contact us about missing, damaged, delayed, or disputed deliveries.

A carrier’s delivery status does not automatically determine the outcome of a delivery claim.

8. Returns, Refunds, and Product Rights

Our voluntary change-of-mind policy allows you to request an eligible return within 28 calendar days after delivery.

After notifying us of your return, you must send the item back within 28 calendar days, following the return instructions we provide.

A 0% restocking fee applies only to eligible voluntary change-of-mind returns where permitted by law and clearly disclosed before purchase.

The fee is calculated on the returned item’s price after discounts, excluding taxes and shipping charges.

No restocking fee applies to:

  • Faulty, damaged, incorrect, or misdescribed products.

  • Returns made under an applicable EU or UK statutory right of withdrawal.

  • Any other return for which such a fee is prohibited by law.

Eligible voluntary refunds are issued within 5–10 business days after we receive the returned item, subject to any shorter mandatory legal deadline.

Our voluntary 28-day policy is additional to statutory rights. It does not shorten any legal claim period or replace separate statutory cancellation rights described in our Return & Refund Policy.

Products must meet applicable legal standards.

Any commercial warranty offered by Azavex Apparel is additional to statutory consumer rights. Depending on applicable law and the circumstances, available remedies may include repair, replacement, price reduction, or refund.

9. Intellectual Property and Customer Materials

Website content, including product photography, graphics, artwork, logos, designs, text, videos, branding, and other materials, belongs to Azavex Apparel or the respective rights holders.

You may use website content for legitimate shopping and personal reference purposes. Other reproduction, distribution, modification, commercial use, or publication requires permission unless otherwise permitted by law.

If you submit artwork, photographs, text, names, logos, designs, or other materials for a customized product, you confirm that you have the necessary rights or authorization to use and submit those materials.

You authorize us and our production providers to use submitted materials only as reasonably necessary to produce, fulfill, deliver, and support your order.

Submitting customer materials does not transfer ownership of those materials to us and does not automatically grant us permission to use them for advertising or promotional purposes.

10. Prohibited Conduct

You must not:

  • Commit or attempt fraud.

  • Infringe intellectual property, privacy, or other legal rights.

  • Upload malicious software, malware, or harmful code.

  • Interfere with website security or operation.

  • Attempt unauthorized access to accounts, systems, or data.

  • Impersonate another person or organization.

  • Use our services for unlawful, abusive, deceptive, or harassing conduct.

We may take reasonable steps to investigate, prevent, or respond to suspected misuse.

11. Privacy and Third-Party Services

Personal information is handled as described in our Privacy Policy.

External websites, payment services, delivery companies, and other third-party providers may have their own applicable terms and privacy notices.

Using third-party providers to support our services does not remove our obligations under your purchase contract or applicable consumer law.

12. Availability and Access Restrictions

Temporary interruptions to the website or services may occur because of maintenance, technical faults, software updates, security incidents, or circumstances outside our reasonable control.

We may reasonably restrict access where necessary to address a security threat, suspected fraud, unauthorized activity, or a serious breach of these Terms.

Where appropriate and legally permitted, we will explain the issue and provide a reasonable opportunity to resolve it.

Access restrictions do not automatically cancel accepted orders or remove rights to customer assistance, refunds, or other remedies.

13. Responsibility and Liability

We are responsible for loss or damage caused by our breach of these Terms or failure to meet legal obligations to the extent required by applicable law.

Where legally permitted, we are not responsible for losses that were not reasonably foreseeable when the relevant contract was made.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability relating to:

  • Fraud or fraudulent misrepresentation.

  • Death or personal injury where liability cannot legally be excluded.

  • Defective products where mandatory liability applies.

  • Mandatory consumer guarantees or statutory rights.

  • Any other matter that cannot lawfully be excluded or limited.

You remain responsible for unlawful conduct or misuse of our website or services as provided by law.

These Terms do not require you to compensate us for losses caused by our own breach, negligence, or unlawful conduct.

14. Changes to These Terms

We may update these Terms to reflect changes in our website, products, services, business practices, or legal obligations.

Updates will display a revised “Last updated” date. Additional notice or agreement will be provided where required by applicable law.

The Terms applicable when an order was accepted continue to govern that purchase unless a change is legally required or expressly agreed with you.

Later updates will not retrospectively reduce rights that already apply to an accepted purchase.

15. Applicable Law and General Provisions

Governing law and the courts with authority to hear a dispute will be determined under applicable legal rules.

Nothing in these Terms removes mandatory consumer protections or any right you may have to bring a claim before a court or other authority with jurisdiction.

If you have a concern regarding an order or our services, contact help@azavex.com.

Contacting us does not prevent you from exercising legal rights or using another available complaint, dispute-resolution, or regulatory process.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply where legally possible.

A delay or failure to enforce a right does not automatically waive that right.

These Terms do not override binding product descriptions, warranties, representations, or commitments that we are legally required to honor.
